The subject of law enforcement wearing bodycams in the USA has been a topic of debate for years now as abuse from law enforcement and the public towards them increased in 2010’s. Now it is no longer a fierce debate as most have agencies have adopted them and transparency has increased. However, with Liberland’s bold “Uber police” approach how does that picture fit in? One minute you are a private citizen the next you are a law enforcement officer, where does the line get drawn in such a situation?
The procedures of one goes from private citizen to law enforcement leaves a bit uneasy, I say this because what if Person A has a beef with Person B. In this scenario Person A decides they will arrest Person B on a trumped up charge of lets say assault since that will be a crime in Liberland. Person A goes over to Person B declares they are law enforcement now and will be arresting them for assault that Person B is to have committed on Person A. Now that is point a few things could happen:
-
Person B complies with the request and goes with them to wherever the jail or whatever housing is to be done for the accused and fights the charge in court, this is not what Person A wants.
-
Person B fights back against Person A and in the process technically commits the assault against Person A which is what Person A really wanted to happen. But with the assault occurring ex post facto to the attempted arrest of Person B how would the court look at this case unless there is corroborating evidence for Person B it would appear evident that Person B is guilty unless Person A has a bodycam on their person at the time of the attempted arrest. But Person A could not make such an accusation if they are required to have a bodycam on at the time of arrest.
I say all of this because one cannot innovate something new just for the sake that something is new. You must have a reason why you want to innovate that new idea AND have ideas laid out for and against it because if you don’t think about the scenario above happening innocent people could be charged and even convicted of a crime they were entrapped into unless evidence shows that they were entrapped and are innocent otherwise.
While that may not happen in Liberland one must still think that it could happen and how to curb such an event like that from happening in the first place. We have not even discussed about what training one must do, any certifications, classes, etc that one may have to do beforehand but these are all questions that must be answered before the criminal justice and judicial system is to be brought into creation in Liberland. Creating a fair and just judicial and criminal justice system could be a good diplomatic overture to Croatia as they see Liberland become more mature about such matters, as it stands now we have no courts or police to enforce any Liberland law, as I have discussed before we must have a judicial system in place before any serious developments occur on Liberland soil.
