(piece-by-piece Constitution) Freedom to E-Organize Groups

(This is my ongoing series presenting pieces that I am formulating into my own constitution for any future country [including LL]. The wording is not set and is open to changes/additions/subtractions. Posting about it is just to stimulate debate, as should any good creator of a constitution.)

Freedom to E-Organize Groups

If average citizens have no capacity to form groups, then govt tyrants and highly-monied persons will always dominate them. Most future groups of humans will come from the internet and since there is no “public” space on the internet, then the privately owned sites that are open to average citizens joining must be regulated as de-facto public spaces.

Any such websites do not get to have their own “community guidelines” and instead must operate using the constitutional guidelines outlined in this constitution. The most pertinent being the freedom of speech, which will not be infringed for unkind words or so-called “hate speech”, etc. Only certain very specific things do not qualify as free speech (planning a crime, directly threatening violence, intimidating with threats of violence).

Such a website can designate a worker to be in charge of protecting the constitutional rights of their users, but anyone within its hierarchy (including the CEO of the company running the website) could potentially be criminally charged with infringing on the constitutional rights to speech of the users.

A private website that is NOT open to the average citizen joining may operate under their own guidelines. Such a site can only grow a user base with non-stranger invites.

Any report of intel-agency style “dirty tricks” or “psyops” to unlawfully disband any group shall be investigated by law enforcement as a potential crime and if an organized group is behind such unconstitutional actions, then conspiracy will be an additional crime added to their charges. Any law enforcer that refuses to investigate such crimes should immediately be investigated themselves.

Some additions will have to be made to the above to deal with internet specific things such as spam posting, and the definition of non-strangers. But beyond that, I feel very good about this one. I think just about every country should adopt this immediately.
