Law of succession

This is not something I want to post but with all of the violence happening here in the US it makes me think of this hypothetical. I hope Liberland has some kind of succession plan in place even though elections occur every 3 months and the president is to be appoint by the cabinet or senate not sure which exactly. There has to be some kind of procedure in place so there is no confusion and or chaos that occurs thereafter the fact.

I have not found any succession triggers besides the vice president becoming president and that only senators are eligible to become president. However there are currently only 4 senators and the bigger question I have now that I realized under the current policy is what happens if there are no more senators, based on this logic there cannot be another president unless we modify the law and allow for a special election to occur.

This is another one of those laws/policies that I hope never has to happen but in my days of being a volunteer for emergency management you must always hope for the best and expect the worst, this is the same logic I apply to this proposal of mine to Congress.

CONGRESS DECISION NO. [2026-Presidential-Succession-12] / 2026
OF THE CONGRESS OF THE FREE REPUBLIC OF LIBERLAND
PRESIDENTIAL SUCCESSION ACT

The Congress of the Free Republic of Liberland,

WHEREAS the principles of meritocracy, voluntary governance, and the Non-Aggression Principle demand clear, transparent, and abuse-resistant mechanisms for leadership continuity;

WHEREAS under current Liberland rules, only individuals who hold Senator status are eligible to serve as President, and the presidential election is conducted exclusively by Senators;

WHEREAS the draft Constitution and Articles of the Provisional Government provide for a President and Vice-President(s), yet lack detailed succession procedures for vacancies due to death, resignation, incapacity, or removal;

WHEREAS only two of the five Ministers currently hold Senator status, requiring the succession order to prioritize Senator eligibility while preserving merit (LLM ranking) and continuity;

WHEREAS blockchain technology enables secure, auditable, and merit-based transitions that align with Liberland’s 90-day meritocracy and LLM system;

WHEREAS this Act builds upon the AI-Assisted Governance Framework, On-Chain Transparency & Anti-Capture Safeguards, the Interim Legislative Process Act (Congress Law);

NOW THEREFORE, the Congress hereby DECIDES and DECLARES as follows:

Article 1 – Definition of Presidential Vacancy
A vacancy in the Office of the President occurs upon:
(a) Death;
(b) Resignation;
(c) Permanent incapacity (certified by a majority of the Cabinet and confirmed by a simple majority vote of Congress within 72 hours); or
(d) Removal via impeachment or future Constitution measures.

Article 2 – Order of Succession (Senator Eligibility Required)
(1) The Vice-President (or the senior Vice-President if multiple exist) shall immediately assume the powers and duties of the President as Acting President.

(2) If no Vice-President is able or willing to serve, succession passes as follows,
(a) The highest Liberland Merit (LLM) Senator (if multiple Senators share the same highest LLM score, the one with the longest continuous service as Senator shall take precedence);
(b) The next-highest LLM Senator, continuing in descending LLM order until no Senator remains eligible or willing to serve.

(3) Once no Senator is available, succession continues in the following order:
(a) The most senior Minister by length of continuous service;
(b) The Prime Minister;
(c) The Speaker of Congress;
(d) The most senior member of Congress by length of continuous service.

Article 3 – Powers and Limitations of the Acting President
The Acting President shall exercise all constitutional and legal powers of the Office but:
(a) Shall not appoint or dismiss Vice-Presidents or dissolve Congress;
(b) Shall not initiate major policy changes outside routine administration;
(c) Must convene Congress within 14 days to confirm or adjust the succession;
(d) Serves for a maximum of 90 days unless Congress extends by simple majority vote for one additional 90-day period.

Article 4 – Special Election
Within 30 days after Article 1 has been triggered an election among the senators must occur among themselves, provided that there is more than one senator in that body.

A special election of the citizens shall be triggered only if no Senator is alive, willing, able, or otherwise accounted for in the line of succession.

In such an extreme circumstance:
(a) The Prime Minister shall immediately direct a special merit-based election using the existing LLM/blockchain system.
(b) Any citizen who is eligible to run for Congress shall be deemed eligible to stand as a candidate for President.
(c) The election shall last 14 days once started on the blockchain. The winner assumes the full Office of President for a full term as defined by the Constitution.

Article 5 – DAO and Blockchain Implementation
To ensure transparency and prevent disputes:
(a) All succession events, certifications of incapacity, and election results shall be recorded immutably on the Liberland blockchain.
(b) Any private citizen may deploy voluntary smart-contract templates (DAOs) for merit tracking, public comment periods, and automated notifications during transitions.
(c) Full on-chain documentation, including medical or resignation statements (redacted only for privacy), shall be published within 24 hours per the Liberland Transparency and Accountability Act.

Article 6 – Safeguards Against Abuse
(a) Any attempt to manipulate succession through force, fraud, or coercion constitutes a violation of the Non-Aggression Principle and shall be adjudicated by the courts.
(c) Congress may, by three-fourths vote, override any succession step if clear evidence of incapacity or abuse emerges.

Article 7 – Entry into Force and Review
This Act enters into force immediately upon adoption and shall be recorded on the Liberland blockchain. It shall be reviewed by Congress no later than 12 months after adoption or upon ratification of the final Constitution, whichever occurs first. The Minister of IT shall publish implementation guidelines and smart-contract templates within 30 days.

Article 8 – Severability

If any provision of this Act is held invalid or unenforceable by the Liberland courts, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.
