Emergency Powers Limitation (Congress Decision #14)

CONGRESS DECISION NO. [2026-Emergency-Powers-Limitation-14] / 2026

OF THE CONGRESS OF THE FREE REPUBLIC OF LIBERLAND

EMERGENCY POWERS LIMITATION ACT

The Congress of the Free Republic of Liberland,

WHEREAS older drafts of the Constitution addressed emergency powers in detail, and any such powers must be strictly temporary to prevent permanent expansion of government;

WHEREAS the Non-Aggression Principle and merit-based governance require that emergencies never become excuses for indefinite authority;

NOW THEREFORE, the Congress hereby DECIDES and DECLARES as follows:

Article 1 – Declaration and Duration

Any declaration of emergency (natural disaster, cyber attack, or similar existential threat) must be made publicly on-chain by the President or Acting President and ratified by a simple majority of Congress within 72 hours. It expires automatically after 30 days unless renewed by a new congressional vote.

Article 2 – Limitations

During an emergency:

(a) No new taxes or compulsory contributions may be imposed.

(b) No suspension of fundamental rights (speech, property, arms, due process) except narrowly tailored measures directly addressing the emergency.

(c) All emergency actions must be fully documented on-chain in real time.

(d) Any emergency decree may be overturned by citizen referendum or congressional vote at any time.

Article 3 – Post-Emergency Review

Within 30 days after an emergency ends, the Minister of IT shall publish a full on-chain report. Congress shall hold a review session to assess actions taken.

Article 4 – Entry into Force

This Act enters into force immediately upon adoption and shall be recorded on the Liberland blockchain.
